Summary of Complaint

ON 9/16/15 THE BRAKES ON MY 2009 HYUNDAI GENESIS FAILED AND THE CAR WOULD NOT STOP AS THE BRAKE PEDAL SANK TO THE FLOOR. I FINALLY GOT THE CAR TO STOP WITH EXCESSIVE PUMPING OF THE BRAKES. ON 9/16/15 I BROUGHT MY CAR INTO JIM ELLIS HYUNDAI TO FIX THE PROBLEM. THE DEALER INSPECTED THE CAR AND COULDN'T REPLICATE THE ISSUE I HAD EXPERIENCED EARLIER IN THE DAY. THE DEALERSHIP RAN DIAGNOSTICS ON THE CAR AND DID NOT FIND ANY PROBLEMS AND NOW THE BRAKES SEEM TO BE WORKING FINE. MY CAR HAS 115,561 MILES. THIS IS THE SECOND VISIT TO THE DEALERSHIP FOR THIS PROBLEM. ON 04/30/15, I BROUGHT IN THE CAR FOR TWO RECALLS, ONE THAT INCLUDED A BRAKE FLUID FLUSH. A MONTH LATER, I HAD A SIMILAR INCIDENT WHILE DRIVING ON THE HIGHWAY THAT CAUSED ME TO LOSE BRAKE PRESSURE.AFTER A FEW DAYS THE PROBLEM SUBSIDED. I AM SERIOUSLY CONCERNED ABOUT THE SAFETY OF THIS AUTOMOBILE, ESPECIALLY AFTER READING SO MANY SIMILAR INCIDENTS ALREADY FILED WITH THE GOVERNMENT.

Summary of Complaint

WITHOUT WARNING, THE BRAKE PEDAL TRAVELED ALMOST TO THE FLOOR OF THE CAR BEFORE STOPPING THE VEHICLE. THE FIRST OCCASION HAPPENED ON AUGUST 7, 2013, BUT THE PROBLEM CORRECTED ITSELF AND THE BRAKES SEEMED FINE UNTIL OCTOBER 20, 2013, WHEN MY HUSBAND AND I WERE VACATIONING IN THE MOUNTAINS OF NORTH CAROLINA, APPROXIMATELY 5 HOURS FROM OUR HOME. AGAIN, WITHOUT ANY WARNING, THE BRAKE PEDAL WENT ALMOST TO THE FLOOR BEFORE STOPPING THE VEHICLE. WE MADE IT HOME SAFELY, BUT THE BRAKE FAILURE WAS A MAJOR SAFETY CONCERN. AFTER SEEING INFORMATION ONLINE ABOUT A RECALL OF THE GENESIS RELATED TO THE BRAKES, WE TOOK THE VEHICLE TO THE HYUNDAI DEALERSHIP IN GOLDSBORO, NC, ON OCTOBER 23, AND THEY REPLACED THE BRAKE FLUID, WHICH FAILED TO CORRECT THE PROBLEM WITH THE BRAKES. THEY TOLD US THE MASTER CYLINDER NEEDED TO BE REPLACED. BASED ON THE HISTORY OF THE PROBLEM, WE DID NOT AGREE WITH THAT DIAGNOSIS AND, ON OCTOBER 24, TOOK THE GENESIS TO JOHNSON HYUNDAI IN RALEIGH, NC, WHERE THEY DETERMINED THE PROBLEM WAS CAUSED BY A FAILURE OF THE HYDRAULIC MODULE FOR THE ANTI-LOCK BRAKE SYSTEM. THE HYUNDAI COMPANY TOLD US THEY ARE CURRENTLY INVESTIGATING THIS VERY SAME PROBLEM WITH THE 2009 GENESIS BUT THE INVESTIGATION IS NOT FAR ENOUGH ALONG TO DETERMINE IF A RECALL WILL BE MADE. FURTHER, THAT WE SHOULD HAVE THE REPAIRS DONE (OVER $2100) AND IF A RECALL IS MADE, WE WOULD BE REIMBURSED. JOHNSON HYUNDAI IS TRYING TO HELP US FIND A RESOLUTION TO THIS ISSUE. TRAVELING TO INDIANA FROM NORTH CAROLINA ON THE 6TH OF MAY 2011. ON A RURAL ROAD TRAVELING APPROXIMATELY 55 MPH, ALL OF A SUDDEN THE ENGINE LIGHT AND ESC WARNING LIGHTS CAME ON. AFTER THAT WHEN I PRESSED ON THE ACCELERATOR, THERE WAS NO POWER. ELECTRICITY WAS STILL THERE AND THE ENGINE WAS STILL ON, BUT NO POWER FROM THE GAS PEDAL. I HAD TO TURN THE EMERGENCY LIGHTS ON AND MOVED ONTO THE SIDE. I WAS LUCKY BECAUSE THERE WEREN'T MANY CARS AROUND. IT WOULD HAVE BEEN PRETTY DANGEROUS IF THERE WERE CARS AROUND AND MY CAR SUDDENLY STOPPED. I WAS ABLE TO TURN THE CAR OFF AND RESTART. WHEN I RESTARTED THE CAR THE ENGINE LIGHT REMAINED ON BUT I HAD REGAIN THE ABILITY TO ACCELERATE. I PULLED INTO A HOTEL AND CALLED HYUNDAI. THE CLOSEST DEALER WAS GADDIS HYUNDAI OF MUNCIE, INDIANA. THE SERVICE DEPARTMENT WAS CLOSING BUT I DISCUSSED WITH TECHNICIAN. HE INDICATED THAT IT WAS COMMON PROBLEM WITH THE THROTTLE SENSOR. HE INDICATED THAT HE WOULD BE ABLE TO FIX IT MONDAY, BUT THAT IF THE LIGHT WENT OFF AND IT WAS RUNNING OK, IT MAY NEVER HAPPEN AGAIN. I TOLD HIM THAT I NEED TO BE DURHAM , NC ON MONDAY. HE INDICATED THAT IF IT HAPPEN AGAIN. TO TURN OFF AND RESTART AND IT SHOULD RESET. ON MY WAY BACK FROM INDIANA TO NORTH CAROLINA I STAYED IN THE RIGHT HAND LANE. ON 4 SEPARATE OCCASIONS THE VEHICLE LOST POWER AND I WAS UNABLE TO ACCELERATE. The contact owns a 2009 Hyundai Genesis. The contact stated that she noticed that the brake lights would not illuminate when the brake pedal was depressed. The contact stated there was no warning light illuminated. The vehicle was taken to a local dealer where it was diagnosed with the stop lamp switch needing to be replaced. The vehicle was repaired however, the failure recurred. The dealer stated that the diode wiring system needed to be replaced. The contact was relating the failure to NHTSA campaign number: 13V113000 (Exterior Lighting). The manufacturer had not been informed of the failure. The failure mileage was approximately 130,394.

A LITTLE OVER A YEAR AGO THE BRAKES ON MY 2009 HYUNDAI GENESIS COMPLETELY FAILED AND THE PEDAL WENT TO THE FLOOR WHILE ATTEMPTING TO EXIT THE FREEWAY. I WAS ABLE TO AVOID A COLLISION WITH ANOTHER VEHICLE AND GOT THE CAR TO A COMPLETE STOP. THE BRAKE PEDAL EVENTUALLY REGAINED PRESSURE AND BEGAN FUNCTIONING AGAIN. OVER THE NEXT 5-6 MONTHS THE BRAKES PROGRESSIVELY GOT WORSE EACH TIME I DROVE THE CAR. I WAS CONSISTENTLY HAVING TO PUMP THE PEDAL AND NEEDED TO KEEP GIVING MYSELF MORE AND MORE DISTANCE TO STOP THE VEHICLE. THROUGHOUT THIS PERIOD THE EXTERIOR BRAKE LIGHTS AND OTHER SENSORS ON THE CAR WOULD STOP FUNCTIONING ENTIRELY FOR PERIODS OF TIME. THOSE LIGHTS AND SENSORS EVENTUALLY QUIT AND NEVER TURNED BACK ON. AT THIS POINT VEHICLE BRAKES WERE GETTING WORSE AND WORSE AND IT HAD NO FUNCTIONING BRAKE LIGHTS SO I TOOK IT TO THE DEALER THAT I ORIGINALLY PURCHASED THE CAR FROM FOR REPAIRS. THE DEALER WAS NOT ASSOCIATED WITH THE MANUFACTURER AND WAS NOT ABLE TO MAKE REPAIRS TO THE CAR BUT THEY WERE ABLE TO DIAGNOSE WHAT WAS GOING ON WITH MY VEHICLE. THEY DOCUMENTED AND DESCRIBED SOME SORT OF CONTAMINATION IN THE BRAKE FLUID THAT HAD TURNED IT INTO A WHITE GOOEY SUBSTANCE AND THAT FLUID CAUSED SIGNIFICANT DAMAGE AND WORE COMPLETELY THROUGH THE ABS MODULE. COINCIDENTALLY THAT IS THE EXACT SAME DESCRIPTION THAT WAS GIVEN FOR THE RECALLS IN 2013 THAT WERE ASSOCIATED WITH THIS MAKE AND MODEL OF CAR (NHTSA CAMPAIGN 13V489000). THE PREVIOUS OWNER DID HAVE THOSE 2013 RECALL REPAIRS MADE AT ABOUT 60,000 MILES BUT THE SAME ISSUES THAT CAUSED THE FIRST RECALL ARE OBVIOUSLY OCCURRING AGAIN WITH THE CAR CURRENTLY AT ABOUT 120,000 MILES. THE MANUFACTURER DEALER WANTS $2500 TO REPLACE THE ABS MODULE AND TO RESET THE COMPUTER WHICH IS OVER HALF OF THE BLUE BOOK VALUE. THAT ALONG WITH THE $1000 ALREADY SPENT TO DIAGNOSE THE PROBLEMS, THE CAR IS NOW BORDERLINE TOTALED AT THIS POINT.

HE ASKED ME TO BRING MY CAR IN AND THEY'LL CHECK IT AGAIN. I SHOWED HIM THE PICTURES AND THEY DENIED THAT IT CAME FROM MY CAR, BUT THEY WOULD FIX MY CAR'S BRAKES FOR $2700.00 WITH NO GUARANTEE THAT IT WOULDN'T COST MORE. THIS WAS TOM AH DEALER SHIP IN LIMA, OHIO. I FEEL THAT HYUNDAI SHOULD BE HELD RESPONSIBLE FOR THESE BRAKE PROBLEMS.I HAVE THE FLUID SAVED AND PICTURES ALSO. UPON CHECKING THE INTERNET, I HAVE BEEN ADVISED THAT THE ESC AND CRUISE CONTROL IS WIRED TO THE ABS SYSTEM. I WAS ON INTERSTATE 75 AND THE CAR JUST STARTED APPLYING THE BRAKES BY THEMSELVES. A RATCHETING ON OFF EFFECT. I SLOWED THE CAR DOWN AND PULLED THE CAR OVER TO THE SIDE. I WAS WITHIN SIGHT OF MY TURNOFF STATE RTE 274 OH, SO I CONTINUED ON. I WENT TO STOP AND MY PETAL WENT TO THE FLOOR. I WAS GOING SLOW, MADE MY TURN AND STOPPED. I GOT UNDER THE HOOD JUST TO SEE IF SOMETHING VISUAL WAS THERE. I WAS WITHIN 7 MILES OF MY HOME A STRAIGHT LINE, SO I WENT FOR IT. I PRESSED ON THE GAS AND MY LEFT FRONT WHEEL WAS LOCKED UP. I BACKED UP AND WENT FORWARD AGAIN, SHUTTING OFF THE CAR & RESTARTING IT. BRAKE WAS RELEASED, BUT PETAL STILL WENT TO THE FLOOR. I DROVE HOME 20 MPH, HAD CAR TOWED TO DEALER FOR REPAIR. DON'T KNOW WHAT THEY DID, BUT CHARGED $677.00. A COUPLE DAYS LATER, MY PETAL WENT TO THE FLOOR AGAIN. THATS WHEN I DID THE REPAIRS NOTED ABOVE. STILL HAVE PROBLEMS.

OUR COMPLAINT IS THAT THE CAR HAS AT LEAST TEN DEALER SERVICE REPAIRS WHICH SHOWS REPLACEMENT OF SEVERAL LIGHTS AND BULBS INCLUDING THE FOG LIGHT INVOLVED IN THE FIRE. FURTHER, THE REPLACEMENT OF BULBS THRU OUT THE VEHICLE HAS SOLELY BEEN DONE AT THE DEALER FOR THE SIMPLE REASON THE REPLACEMENT OF THE FOG LIGHTS NEEDS TO BE DONE BY A CERTIFIED MECHANIC. AN INSINUATION BY THE DEALER THAT WE ARE SOMEHOW RESPONSIBLE FOR THIS FIRE AND THE COST OF REPLACING THE FOG LIGHT AND BUMPER IS ABSURD AND FALSE. TL* THE CONTACT OWNS A 2009 HYUNDAI GENESIS. WHILE APPROACHING A STOP, THE ENGINE REVVED AND THE BRAKE PEDAL DEPRESSED SLIGHTLY. THE VEHICLE WAS TAKEN TO THE DEALER (KEY HYUNDAI IN JACKSONVILLE, FL, 904-642-6060), BUT THE FAILURE WAS NOT DUPLICATED. THE MANUFACTURER WAS MADE AWARE OF THE FAILURE AND SENT AN INVESTIGATOR WHO WAS UNABLE TO DUPLICATE THE FAILURE. THE VEHICLE WAS NOT REPAIRED. CAR DRIVING ON HIGH AND WHEN TRY TO STOP THROUGH TOLL BOOTH IT WAS NO BRAKE AND HIT TO THE FLOOR. IT GOT SOME BRAKE AFTER HIT TO THE FLOOR, AND AFTER THAT I PUMPED THE BRAKE COUPLE TIMES AND AFTER ABOUT HIT TO THE FLOOR 4 TIMES, IT FINALLY CAME BACK WITH NORMAL. THIS HAPPENED TWICE IN THE PAST MONTH. DOES NOT HAPPEN ALL THE TIME. I HAD THE RECALL 114 DONE 4 YEARS AGO BUT WAS JUST REPLACED BRAKE FLUID, THE HECU WAS NOT REPLACED.
