AT 15K MILES THE DRIVER'S SIDE REAR BRAKE CALIPER FAILED, CAUSING THE BRAKE TO DRAG AND OVERHEAT DURING A 400 MILE HOLIDAY ROADTRIP. BY THE TIME THE PROBLEM WAS DISCOVERED BY THE ELDERLY OWNERS, THE REAR PADS WERE WORN DOWN TO THE BACKING PLATES AND THE ROTORS WERE HEAVILY SCORED. THERE WERE NO WARNING LIGHTS ILLUMINATED OR OTHER INDICATION ALERTING THE DRIVER TO THE PROBLEM. THIS IS A KNOWN ISSUE WITH THE REAR CALIPERS AND ELECTRIC PARKING BRAKE (EPB) GIVEN THE TSBS THAT MAZDA HAS PUBLISHED ON THE MATTER AS WELL AS THE NUMBER OF COMPLAINTS ONLINE AND WITH THE NHTSA. MAZDA REPLACED THE FAILED DRIVER'S SIDE CALIPER UNDER WARRANTY BUT DECLINED TO COVER THE DAMAGED PADS AND ROTOR CAUSED BY THEIR DEFECTIVE ASSEMBLY EVEN AFTER ESCALTING THE ISSUE TO CORPORATE. THIS SHOULD BE A SAFETY RECALL BUT MAZDA WOULD RATHER JEOPARDIZE THE SAFETY OF THEIR CUSTOMER (BY NOT PROACTIVELY REPLACING THE PASSENGER SIDE CALIPER) AND CHARGE THEM $500 FOR A BRAKE JOB TO CORRECT COLLATERAL DAMAGE CAUSED BY THEIR DEFECTIVE PARTS. WE HAVE BEEN LONG-TIME LOYAL CUSTOMERS OF MAZDA BUT THEY HAVE ACTED UNETHICALLY IN THIS INSTANCE AND DID NOT FULFILL THEIR WARRANTY CLAIM IN GOOD FAITH.

MADE HIM DOCUMENT THEIR REFUSAL TO REPLACE ON MY SERVICE RECORD & TOLD HIM IT WAS UNACCEPTABLE & THAT I WAS GOING TO FILE A COMPLAINT WITH MAZDA USA & NHTSA. MY DEALERSHIP INSISTED IT WAS MY BATTERY (BASICALLY THE ONLY WARNING LIGHT NOT ON) AND MY REAR BRAKE PADS. THEN WHEN THIS DID NOT CORRECT THE ISSUE, THEY SAID CORROSION NEEDED TO BE CLEANED WHICH WAS NOT SHOWN IN THE VEHICLE INSPECTION VIDEO. ALSO, MY CAR WAS JUST SERVICED AT MY MAZDA DEALERSHIP JULY 2020 WITH 33,706 MILES. SEPTEMBER 2020 MY VEHICLE WAS PARKED AND I RETURNED TO A LARGE CRACK ON THE DRIVER SIDE. I DID SOME RESEARCH ONLINE AND IT SEEMS TO BE A COMMON PROBLEM WITH THE PARKING BRAKE DRAGGING FOR 2016 CX5. SO I STOPPED USING THE PARKING BRAKE AND THE OVERHEATING PROBLEM WAS GONE. HOWEVER, THE PARKING BRAKE IS STILL DEFECTIVE AND CAUSES OVERHEAT IF USED.

I TRIED TO BOOK AN APPOINTMENT AGAIN TO HAVE THIS FIXED ON 11/11/20 - AN APPOINTMENT THEY ACCEPTED ONLY TO BE TOLD ONCE I GOT THERE AFTER THE INSPECTION THAT THEY DO NOT HAVE THE PARTS AND CANNOT GET THE PARTS FROM MAZDA. I WAS ONE OF THE INITIAL CUSTOMERS TO REPORT THIS ISSUE AND RECEIVED A NEW HEADLIGHT ASSEMBLY FOR THE DRIVER'S SIDE REPLACEMENT AND NOT SIX MONTHS LATER, THE OTHER SIDE WENT OUT. THEY TRIED CONTACTING MAZDA DEALERSHIPS AND 3RD PARTY SOURCES FOR EITHER NEW OR REBUILT CALIPER BUT THE PART WAS OUT OF STOCK AND ON BACKORDER WITH NO ESTIMATED DATE WHEN IT WOULD BE REPLENISHED. MY CAR IS STILL UNREPAIRED AND I CANNOT DRIVE IT AS THE EXCESSIVE HEATING OF THE ROTOR COULD DISABLE MY BRAKING ABILITY. THIS SEEMS TO BE A COMMON ISSUE WITH OTHER CX-5 MODELS.

I CONTACTED THE MAZDA DEALERSHIP WHERE I PURCHASED MY VEHICLE AND TOOK MY VEHICLE IN TO BE SERVICED JULY 13, 2020. AT THIS TIME, I WAS TOLD BY MAZDA THAT THE PART NECESSARY FOR THE REPAIR WAS ON BACKORDER, AND WOULD BE RECEIVED IN APPROXIMATELY THREE WEEKS. I CALLED TO FOLLOW UP ON THIS IN LATE AUGUST. I WAS TOLD BY THE MAZDA SERVICE DEPARTMENT THAT THE PART WAS ON BACKORDER WITH NO ETA ON ITS AVAILABILITY. I HAVE NOT EXPERIENCED ANY PROBLEM WHILE DRIVING, BUT I AM FILING THIS COMPLAINT BECAUSE MY RECALL NOTICE STATED THAT I SHOULD REPORT IF "MAZDA DOES NOT REPAIR THE DEFECT WITHIN A REASONABLE AMOUNT OF TIME." I LIVE IN THE STATE OF HAWAII AND VEHICLES ARE REQUIRED TO HAVE AN ANNUAL SAFETY INSPECTION COMPLETED. DUE TO THE RECALL AND DEFECT OF MY HEADLIGHTS, MY VEHICLE IS UNABLE TO PASS THE SAFETY INSPECTION. MY SAFETY INSPECTION WAS DUE TO BE COMPLETED IN JUNE 2020. MY VEHICLE IS NOW OUT OF COMPLIANCE WITH THE STATE. I WILL BE UNABLE TO PASS THE SAFETY INSPECTION UNTIL MAZDA REPLACES AND REPAIRS THE RECALLED ITEM.
