Summary of Complaint

AT 15K MILES THE DRIVER'S SIDE REAR BRAKE CALIPER FAILED, CAUSING THE BRAKE TO DRAG AND OVERHEAT DURING A 400 MILE HOLIDAY ROADTRIP. BY THE TIME THE PROBLEM WAS DISCOVERED BY THE ELDERLY OWNERS, THE REAR PADS WERE WORN DOWN TO THE BACKING PLATES AND THE ROTORS WERE HEAVILY SCORED. THERE WERE NO WARNING LIGHTS ILLUMINATED OR OTHER INDICATION ALERTING THE DRIVER TO THE PROBLEM. THIS IS A KNOWN ISSUE WITH THE REAR CALIPERS AND ELECTRIC PARKING BRAKE (EPB) GIVEN THE TSBS THAT MAZDA HAS PUBLISHED ON THE MATTER AS WELL AS THE NUMBER OF COMPLAINTS ONLINE AND WITH THE NHTSA. MAZDA REPLACED THE FAILED DRIVER'S SIDE CALIPER UNDER WARRANTY BUT DECLINED TO COVER THE DAMAGED PADS AND ROTOR CAUSED BY THEIR DEFECTIVE ASSEMBLY EVEN AFTER ESCALTING THE ISSUE TO CORPORATE. THIS SHOULD BE A SAFETY RECALL BUT MAZDA WOULD RATHER JEOPARDIZE THE SAFETY OF THEIR CUSTOMER (BY NOT PROACTIVELY REPLACING THE PASSENGER SIDE CALIPER) AND CHARGE THEM $500 FOR A BRAKE JOB TO CORRECT COLLATERAL DAMAGE CAUSED BY THEIR DEFECTIVE PARTS. WE HAVE BEEN LONG-TIME LOYAL CUSTOMERS OF MAZDA BUT THEY HAVE ACTED UNETHICALLY IN THIS INSTANCE AND DID NOT FULFILL THEIR WARRANTY CLAIM IN GOOD FAITH.

WHEN I GOT IN MY CAR TO GO HOME, MY WINDSHIELD HAD A LARGE CRACK DOWN THE MIDDLE FROM THE TOP SPREADING OUT ON BOTH DRIVER & PASSENGER SIDES INTO THE VIEWING AREA LIKE A SPIDER WEB. IT STARTED RIGHT WHERE THE BLACK PLASTIC HOUSING IS FOR THE TECH PKG SENSORS BEHIND THE MIRROR. I STOPPED AT TECHNIGLASS ON MY WAY HOME & DAMON CHECKED IT OUT & SAID THERE WAS NO SIGN OF A ROCK CHIP, IT WAS A STRESS CRACK AND IT SHOULD BE COVERED UNDER FACTORY WARRANTY & THAT HE HAS SEEN IT A LOT ON CX-5'S. ALSO TOLD ME THE WINDSHIELDS WERE ON BACK ORDER & THEY COST $1100. THE FOLLOWING DAY I TOOK IT TO DAHLE MAZDA IN SLC FOR 15,000 MILE SERVICE & SHOWED THEM THE CRACK & ASKED THEM TO REPLACE IT UNDER THE FACTORY WARRANTY. THEY CAME BACK & TOLD ME THEY DID FINE POINT PEN TRICK & THERE WERE TWO ROCK CHIPS & IT IS NOT WARRANTABLE. I SHOWED THEM TECHNIGLASS NOTE SHOWING THERE WERE NO ROCK CHIPS & THEIR DIAGNOSIS OF A STRESS CRACK. ASKED FOR THE SERVICE MANAGER & SHARED THIS INFO & 30+ COMPLAINTS FROM ONLINE NHTSA & MAZDA247.COM WEBSITES CONFIRMING THE DEFECT WITH OTHER CX 5 OWNERS. MADE HIM DOCUMENT THEIR REFUSAL TO REPLACE ON MY SERVICE RECORD & TOLD HIM IT WAS UNACCEPTABLE & THAT I WAS GOING TO FILE A COMPLAINT WITH MAZDA USA & NHTSA. HE SAID HE WOULD ALSO CHECK WITH MAZDA USA TO SEE IF HE COULD DO ANYTHING & THAT HE WOULD CALL ME BACK'..HE NEVER DID. I ALSO LEARNED THAT TECHNIGLASS AND OTHER 3RD PARTY WINDSHIELD REPLACEMENT COMPANIES CANNOT GET THESE REPLACEMENT WS FROM THEIR SUPPLIERS, THEY MUST ORDER THEM DIRECT FROM THE MAZDA DEALER, WHICH I FIND CONCERNING. THE FOLLOWING WARNING AND WARNING LIGHTS BEGAN AROUND 34,980 MILES ON MY 2016.5 MAZDA CX-5 GRAND TOURING 2.5L SKYACTIV-G WHILE DRIVING DOWN THE INTERSTATE: MASTER WARNING LIGHT, CHECK ENGINE LIGHT, POWER STEERING, KEYLESS SYSTEM MALFUNCTION, SMART CITY BRAKE SUPPORT MALFUNCTION, FORWARD SCBS DISABLED, CHECK ENGINE LIGHT, TCS/DSC INDICATOR LIGHT, TCS OFF INDICATOR LIGHT, BLIND SPOT MONITORING (BSM) OFF INDICATION, BRAKE SYSTEM WARNING LIGHT, ABS WARNING LIGHT, ELECTRIC BRAKE WARNING LIGHT, AIR BAG/FRONT SEAT BELT PRETENSIONER SYSTEM WARNING LIGHT, TIRE PRESSURE MONITORING SYSTEM WARNING LIGHT, LED HEADLIGHT WARNING LIGHT, AND THE SPEEDOMETER DOES NOT WORK. THE VEHICLE TAKES SEVERAL ATTEMPTS TO TURN OFF. USING THE LEFT BLINKER WILL CAUSE THE VEHICLES POWER TO RESTART AND YES, WHILE DRIVING! THIS STARTED NOVEMBER 14, 2020 AND WHEN I NOTIFIED MAZDA, THEY DID NOT SEEM CONCERNED AND A COUPLE DAYS LATER THE LIGHT WERE NO LONGER THERE. THIS OCCURRED AGAIN DECEMBER 15, 2020 AND MARCH 5, 2021 WHEN I DECIDED MAZDA NEEDS TO RUN A DIAGNOSIS BECAUSE CLEARLY SOMETHING IS NOT RIGHT. MY DEALERSHIP INSISTED IT WAS MY BATTERY (BASICALLY THE ONLY WARNING LIGHT NOT ON) AND MY REAR BRAKE PADS. THEN WHEN THIS DID NOT CORRECT THE ISSUE, THEY SAID CORROSION NEEDED TO BE CLEANED WHICH WAS NOT SHOWN IN THE VEHICLE INSPECTION VIDEO. ALSO, MY CAR WAS JUST SERVICED AT MY MAZDA DEALERSHIP JULY 2020 WITH 33,706 MILES. SEPTEMBER 2020 MY VEHICLE WAS PARKED AND I RETURNED TO A LARGE CRACK ON THE DRIVER SIDE. AROUND 25,000 THE TIRED NEEDED TO BE REPLACED, NOW AT 36,666 MILES TIRE THREAD DEPTH IS IN THE YELLOW' MY VEHICLE ALIGNMENT HAS ZERO ISSUES AND MY MAZDA DEALERSHIP IS THE ONLY ONE WHO ROTATES THE TIRES (OR SUPPOSE TO).

THE ELECTRONIC PARKING BRAKE ON MY 2016 MAZDA CX-5 STARTED ACTING STRANGE A FEW WEEKS AGO. AT FIRST IT WOULD NOT DISENGAGE AFTER STARTING THE CAR, BUT WOULD DO SO AFTER A COUPLE OF RESTARTS. THEN IT STARTED ENGAGING SLIGHTLY WHILE DRIVING, WITH NO INDICATIONS. STOPPING AND RESTARTING THE ENGINE A FEW TIMES WOULD USUALLY RELEASE IT. A COUPLE OF DAYS AGO THIS HAPPENED AND THE BRAKE WOULD NOT DISENGAGE AFTER SEVERAL RESTARTS AND I WAS GOING TO CALL A TOW TRUCK. IT DISENGAGED AFTER ABOUT 30 MINUTES. AS I UNDERSTAND IT MAZDA KNOWS THAT THE REAR CALIPER IS DEFECTIVE (SEE TECHNICAL SERVICE BULLETIN R052/16C). THIS SHOULD BE A RECALL ITEM BECAUSE THIS IS NOT SAFE.

THEY TRIED CONTACTING MAZDA DEALERSHIPS AND 3RD PARTY SOURCES FOR EITHER NEW OR REBUILT CALIPER BUT THE PART WAS OUT OF STOCK AND ON BACKORDER WITH NO ESTIMATED DATE WHEN IT WOULD BE REPLENISHED. MY CAR IS STILL UNREPAIRED AND I CANNOT DRIVE IT AS THE EXCESSIVE HEATING OF THE ROTOR COULD DISABLE MY BRAKING ABILITY. THIS SEEMS TO BE A COMMON ISSUE WITH OTHER CX-5 MODELS.

I RECEIVED A SAFETY RECALL NOTICE IN MARCH 2020 REGARDING LED DAYTIME RUNNING LIGHTS. I CONTACTED THE MAZDA DEALERSHIP WHERE I PURCHASED MY VEHICLE AND TOOK MY VEHICLE IN TO BE SERVICED JULY 13, 2020. AT THIS TIME, I WAS TOLD BY MAZDA THAT THE PART NECESSARY FOR THE REPAIR WAS ON BACKORDER, AND WOULD BE RECEIVED IN APPROXIMATELY THREE WEEKS. I CALLED TO FOLLOW UP ON THIS IN LATE AUGUST. I WAS TOLD BY THE MAZDA SERVICE DEPARTMENT THAT THE PART WAS ON BACKORDER WITH NO ETA ON ITS AVAILABILITY. I HAVE NOT EXPERIENCED ANY PROBLEM WHILE DRIVING, BUT I AM FILING THIS COMPLAINT BECAUSE MY RECALL NOTICE STATED THAT I SHOULD REPORT IF "MAZDA DOES NOT REPAIR THE DEFECT WITHIN A REASONABLE AMOUNT OF TIME." I LIVE IN THE STATE OF HAWAII AND VEHICLES ARE REQUIRED TO HAVE AN ANNUAL SAFETY INSPECTION COMPLETED. DUE TO THE RECALL AND DEFECT OF MY HEADLIGHTS, MY VEHICLE IS UNABLE TO PASS THE SAFETY INSPECTION. MY SAFETY INSPECTION WAS DUE TO BE COMPLETED IN JUNE 2020. MY VEHICLE IS NOW OUT OF COMPLIANCE WITH THE STATE. I WILL BE UNABLE TO PASS THE SAFETY INSPECTION UNTIL MAZDA REPLACES AND REPAIRS THE RECALLED ITEM.
