WE HAD A BRAKE BOOSTER VACUUM LINE THAT CONNECTS TO THE ALUMINUM INTAKE WITH A PLASTIC FITTING ON A 2002 MERCEDES CLK320 (173K MILES) THAT GOT BRITTLE AND BROKE. THANKFULLY NO ONE WAS INJURED OR KILLED. I'M AN EX-MECHANIC AND HAVE NEVER SEEN PLASTIC FITTING USED FOR THE VACUUM LINE TO THE BRAKE BOOSTER ON THE ENGINE. OVER TIME THIS WILL GET BRITTLE AND BREAK. THIS VACUUM LINE DOES 2 THINGS, #1 IT KEEPS THE CAR RUNNING WITH NORMAL POWER, #2 ALLOWS YOU TO HAVE BRAKES THAT OPERATE NORMALLY. I HAVE DONE A QUICK SEARCH AND IT'S NOT JUST MERCEDES, OTHER MANUFACTURERS DO THIS IN SOME AND/ OR ALL MODELS OF THEIR CARS. THIS WAS A WAKE UP CALL FOR ME ESPECIALLY BEING A MECHANIC. IF I SAW THIS AS A MECHANIC IT WOULD HAVE BEEN REPORTED. THIS IS A MAJOR CATASTROPHE WAITING TO HAPPEN. PEOPLE ARE KEEPING CARS LONGER AND IF THIS PLASTIC GETS BRITTLE AND BREAKS WHILE OUT ON THE HIGHWAY THE PERSON COULD LOSE ENGINE POWER AND/ OR BRAKING POWER. WENT TO PUT MY TOP UP ON MERCEDES CABRIOLET PARKED IN MY DRIVEWAY. WITH THE KEY ON AND THE VEHICLE TURNED OFF, IN PARK, PARKING BRAKE ON, PRESSED CLOSURE BUTTON. DURING CLOSURE HEADRESTS BEGAN TO RAISE. NOT A SUDDEN POP UP KIND OF RAISING, BUT A SLOW, STEADY RAISING, AS IF I HAD MY HAND ON THE BUTTON TO RAISE THEM, YET I DID NOT. IT'S ON THE DASH, AND I WAS THE ONLY ONE IN THE CAR, AND HAD NO ITEMS IN THE CAR EITHER. FOR THE RECORD, WHILE FEMALE, I GREW UP RACING CARS, HAVE CHANGED MY OWN ENGINE, TURBO, TRANSMISSION, SHOCKS, SPRINGS, ETC. THESE TWO SEAT AND TOP PROCESSES ARE MUTUALLY EXCLUSIVE SO THEN NEITHER WOULD WORK. CLEARLY UP THEY GREATLY IMPACT VISIBILITY PLUS THE TOP WILL NOT GO UP. SECONDLY TO GET THE TOP OVER THE HEADRESTS, ACCORDING TO THE MANUAL IT'S IMPOSSIBLE, BUT SAID ANOTHER WAY, IT'S A FOUR PERSON JOB. GIVEN THE LIMITED VISIBILITY OF THE CABRIOLET TOP UP ANYWAY, ADDING THE RAISED HEADRESTS, NOW IT'S A SERIOUS SAFETY ISSUE. THE TOP BLOCKS 2/5 OF THE VISIBILITY. THE HEADRESTS UP BLOCK 2/5 OF THE VISIBILITY. ALL THAT IS LEFT IS THE 1/5 BETWEEN THEM - A VERY NARROW RANGE OF VIEW. AT THE DEALERSHIP, THEY KNOW EXACTLY WHAT IT IS.THEY SAY WHEN THEY DEPLOY FALSELY IT'S LIKE AIRBAGS AND THEY CANNOT JUST GO BACK DOWN AND THEY REPLACE A NUMBER OF THESE. IF THIS IS SUPPOSED TO DEPLOY IN THE EVENT OF A ROLLOVER OR ACCIDENT, FOR THIS TO DEPLOY WITHOUT HITTING ANYTHING, YET TO IMPACT VISIBILITY WITH NO WAY TO RETURN TO NORMAL VISIBILITY OR PROTECT YOURSELF FROM THE ELEMENTS, SURELY THIS IS A SAFETY ISSUE. Summary of Complaint

I PURCHASED A CERTIFIED PRE-OWNED 2002 MERCEDES BENZ CLK320. WITHIN THE FIRST MONTH OF PURCHASE I BEGAN TO HAVE PROBLEMS WITH THE AMPLIFIER WHICH WAS LATER DISCOVERED AFTER BEING REPLACED 3 TIMES GETTING WET WHENEVER THE CAR BECAME WET. RESULTING IN A CRACKLING AND POPPING SOUND ULTIMATELY LEADING TO COMPLETE FAILURE OF THE AUDIO SYSTEM. AFTER COMPLAINING TO THE DEALER WHERE I PURCHASED THE VEHICLE, I WAS REFERED TO A MERCEDES BENZ REPAIR SHOP. THEY CLAIMED TO NOT BE ABLE TO FIND THE PROBLEM AFTER WETTING THE CAR WHICH WAS A LIE UPON WASHING THE VEHICLE SHORTLY AFTER RECIEVING THE BACK FROM THE REPAIR SHOP. ULTIMATELY THE AUDIO SYSTEM HAD CASTROPHIC FAILURE WHICH RESULTED IN A VERY LOAD SQEALING SOUND WHICH BLEW OUT THE AMPLIFIER THE LEFT DOOR SPEAKER AND MY EAR WHICH HAS RESULTED IN PERMANENT RINGING IN MY EARS, AND HEARING LOSS WHICH HAS COST ME TO DATE NEARLY $4000.00 DOLLARS IN MEDICAL BILLS AND HAS PERMANENTLY ALTERED MY LIFE AFFECTING MY ABILITY TO SLEEP, FINISHED SCHOOL AND DEPPRESSION. THIS WAS MY CELEBRATION CAR FOR WORKING HARD TO GET INTO MY CURRENT FIELD AS A COMPUTER SPECIALIST FOR THE DOD. I NOW HAVE TO TAKE SLEEPING AIDS TO GET TO SLEEP. AND GOD FORBID IF I WAKE UP DURING THE NIGHT BECAUSE GOING BACK TO SLEEP IS NEARLY IMPOSSIBLE. I HAD NO IDEA THIS WAS AN ISSUE WITH MERCEDES BENZ VEHICLES BUT FURTHER INVESTIGATION ON THE INTERNET HAS LED ME TO A COUPLE OF WEBSITES OF AUDIO REPAIR SHOPS IN FLORIDA AND CALIFORNIA WHICH SHOW THIS IS A NATIONAL PROBLEM. MERCEDES BENZ ULTIMATELY DISCOVERED IT WAS DEFECTIVE DRAIN PLUGS DIRECTLY OVER THE AMPLIFIER WHICH ALLOWED WATER TO LEAK DIRECTLY ONTO THE AMPLIFIER WHEN THE CAR GETS WET INCLUDING WITH MORNING DEW WHICH THE WATER DRAINS DIRECTLY ONTO THE AMPLIFIER. THE AMPLIFIER BLEW UP WHILE DRIVING TO WORK AND FORTUNENATELY FOR ME NO OTHER PERSON WAS INJURED AS I HAD TO PULL OVER BECAUSE I THOUGHT THE CAR WAS GOING TO EXPLODE; THE SOUND WAS THAT LOAD. THE CAR HAD A LITTLE OVER 19,000 MILES WHEN THIS OCCURED

Summary of Complaint

WHEN DRIVING ON RTE 6 IN HYANNIS, MASSACHUSETTS IN MY MERCEDES CLK 430 (THE DROP DOWN OPTIONS ONLY INCLUDE CLK 320) , THE "BATTERY ALTERNATOR" LIGHT WENT ON ON THE DASHBOARD. WITHIN SECONDS THE ENTIRE CAR SHUT DOWN AT HIGH SPEED. FORTUNATELY THERE WAS NO ONE IN THE RIGHT LANE AND I WAS ABLE TO PULL OVER WITH A VERY HARD STOP ONTO THE SHOULDER. THE LOCAL DEALERSHIP SAID THAT THERE WAS AN "OPEN RECALL" ON MY CAR FOR PRECISELY THIS PROBLEM. I CALLED THE MANUFACTURER TO FIND OUT WHY I NEVER RECEIVED A RECALL NOTICE. THEY CLAIMED THERE WAS NO RECALL FOR THIS PROBLEM BUT INSTEAD A "SERVICE BULLETIN" WAS ISSUED AND THAT, UNDER THIS CIRCUMSTANCE NO NOTICES WERE REQUIRED TO BE SENT TO THE CAR OWNER. THE RATIONALE WAS THAT THIS WAS NOT DEEMED A "SAFETY" ISSUE. I FAIL TO UNDERSTAND HOW THE POSSIBILITY OF A TOTAL SHUT DOWN OF THE CAR COULD NOT BE DEEMED TO BE A SAFETY ISSUE. I WAS TOLD THAT THE DEALERSHIPS CAN VOLUNTARILY CORRECT THE PROBLEM IF AND WHEN THE CAR IS BROUGHT IN FOR SERVICE. IF THE CAR IS NOT BROUGHT IN THE POTENTIAL PROBLEM PERSISTS. THE FRONT OF MY CAR WAS DAMAGED DUE TO THE HARD STOP. ALTHOUGH THE ELECTRICAL PROBLEM HAS BEEN REPAIRED (THE BUMPER HAS NOT) I HAVE NOT YET PICKED UP MY CAR SO I AM UNSURE AS TO WHETHER I WILL BE CHARGED FOR CORRECTING THE PROBLEM. I WAS LED TO BELIEVE BY THE DEALER THAT I WOULD NOT BE CHARGED SINE THIS IS A RECALL BUT THE MANUFACTURER SAID THAT MIGHT NOT BE THE CASE. *NM

1. FAILURE OF DRIVER'S SIDE DOOR AND PASSENGER DOOR TO LOCK OR UNLOCK. 2. FAILURE OF DEALERSHIP TO PERMANENTLY FIX PROBLEM. IT GETS FIXED BUT IT BREAKS DOWN AGAIN. THE DRIVER'S SIDE DOOR MAY WORK; THEN IT MAY NOT WORK; THEN IT MAY WORK. 2. FAILURE OF DEALERSHIP TO PERMANENTLY FIX PROBLEM. IT IS SUPPOSEDLY FIXED WHEN I LEAVE THE DEALERSHIP - BUT IT FAILS AGAIN. IT HAS NOW FAILED AGAIN FOR THE DOOR TO BE UNLOCKED. 3. THE DEALERSHIP CORRECTS THE PROBLEM BUT IT AGAIN FAILS; NOW IT HAS FAILED TO GET DRIVER'S SIDE DOOR DOES NOT OPEN AGAIN AND I HAVE TO PHYSICALLY UNLOCK THE DOOR FOR IT TO OPEN. AND SOMETIME WHEN I AUTOMATICALLY LOCK THE DOOR BY THE TRANSMITTER; ALL THE DOORS EXCEPT MY DRIVER'S SIDE DOOR DOES NOT LOCK. THIS IS DANGEROUS SINCE IF I ENTER THE VEHICLE WITH THE ONE DOOR LEFT UNLACHED - SOMEONE CAN HIDE IN THE BACK OR ALSO IN A CRASH MY DOOR MAY OPEN UP SINCE I CANNOT LOCK THE DOOR. *JB

CONSUMER STATED HE PURCHASED A LEMON. SINCE PURCHASING THE VEHICLE IT HAS BEEN IN THE REPAIR SHOP 4-5 TIMES AND EACH TIME AT LEAST A MONTH. THE AIR BAG LIGHT CAME ON AND WENT OFF INTERMITTENTLY. DEPLOYED AIRBAGS INJURE 2 PA. FIREFIGHTERS DAVE SOMMERS, STAFF WRITER APRIL 24, 2003 EDGELY, PA. FIREFIGHTERS FACE A LOT OF HAZARDS EVERY TIME THEY SUIT UP. BUT THEY DON'T EXPECT TO BE STRUCK BY AUTOMOBILE AIRBAGS SUCH AS WHAT OCCURRED ON TUESDAY WHEN EDGELY FIRE COMPANY FIREFIGHTERS RESPONDED TO A CAR FIRE IN THE 3M INDUSTRIAL PARK IN BRISTOL TOWNSHIP. IN FACT, OFFICIALS SAID ANDY TAGGART, 25, WAS KNOCKED OUT WHEN THE DRIVER-SIDE AIRBAG ON A 2002 MERCEDES BENZ INEXPLICABLY DEPLOYED AS THE VETERAN FIREFIGHTER WAS CHECKING THE DASH FOR DAMAGE. A SECOND FIREFIGHTER, RYAN FLANAGAN, 18, WAS SLIGHTLY INJURED WHEN HE WAS STRUCK IN THE HEAD BY A PARTIALLY DEPLOYING AIRBAG AS HE WAS CHECKING THE RIGHT SIDE OF THE FRONT DASH, OFFICIALS SAID. BOTH WERE RUSHED TO ST. MARY MEDICAL CENTER IN LANGHORNE WHERE THEY WERE KEPT FOR OBSERVATION AND THEN RELEASED EARLY YESTERDAY. FLANAGAN SAID EDGELY RESPONDED TO THE FIRE SCENE AROUND 9:38 P.M. AFTER LEARNING THAT A 2002 MERCEDES BENZ WAS ON FIRE IN FRONT OF A&Z AUTOMOTIVE ON MANNING BOULEVARD. WHEN FIREFIGHTERS ARRIVED, THEY SAW SMOKE COMING FROM UNDER THE DASH AND BEGAN TO GET THE SITUATION UNDER CONTROL. THE DRIVER SIDE AIRBAG BLEW WITH SUCH FORCE IT KNOCKED TAGGART UNCONSCIOUS WHILE THE PASSENGER SIDE BAG, WHICH ONLY PARTIALLY DEPLOYED, STRUCK A GLANCING BLOW OFF THE SIDE OF RYAN FLANAGAN'S HEAD. BOTH FIREFIGHTERS WERE WEARING HELMETS, WHICH LIKELY SAVED THEM FROM FURTHER INJURY. AEROSTAR, THE SECURITY COMPANY WHICH ELECTRONICALLY MONITORS LUXURY CARS SUCH AS THE MERCEDES, HAD AUTOMATICALLY CALLED 911 WHEN IT DETECTED A FIRE UNDER THE DASHBOARD. THE AEROSTAR SYSTEM ALSO AUTOMATICALLY UNLOCKED THE CARS DOORS AND CONTACTED THE OWNER, WHO WAS NOT WITH THE VEHICLE AT THE TIME. THE FIRE INSIDE THE MERCEDES WAS EXTINGUISHED BEFORE IT COULD CAUSE MUCH DAMAGE. *NLM

THE VEHICLE WAS EQUIPPED WITH A SAFETY FEATURE WHICH AUTOMATICALLY REDUCES THE SPEED OF THE VEHICLE TO 20-30 MPH WHEN VARIOUS SENSORS DETECT SOME SORT OF MECHANICAL DIFFICULTY. WHILE THE CONSUMER WAS DRIVING ABOUT 60 MPH THE SAFETY FEATURE ACTIVATED AND THE VEHICLE SPEED WAS REDUCED. THE DRIVER WAS FORCED TO PULL OVER AND THE VEHICLE WAS TOWED TOT HE DEALER. I WAS LATER DETERMINED THAT A FAULTY ESP CONTROL MODULE SENT A FALSE WARNING TO THE SYSTEM THAT MADE THE VEHICLE REDUCE SPEED. MY MAJOR CONCERN IS WITH REGARD TO THE FAILURE OF ABS AND TRACTION CONTROL WHILE DRIVING IN THE SNOW DURING THE SNOW STORM ON DEC 5TH. THESE SYSTEMS ARE SUPPOSED TO PROVIDE A LAYER OF SAFETY IN THESE CONDITIONS. WHEN I CONTACTED MERCEDES ROADSIDE ASSISTANCE, THEY INFORMED ME THAT THE SENSORS MUST HAVE GOTTEN WET AND THEREFORE MADE THE SYSTEM INOPERABLE. THEN DOES THIS MEAN THAT THERE IS AN INHERRENT DESIGN PROBLEM WITH THIS VEHICLE. I HOPE YOU WILL TAKE A LOOK INTO THIS PROBLEM, BEFORE ANYONE ELSE HAS TO GO THROUGH A NIGHTMARE DRIVING SITUATION AS I HAD TO. THAT I DID NOT GET INTO AN ACCIDENT IS A MIRACLE.
