Summary of Complaint

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

ABOUT A YEAR AGO, ONE REAR SPEAKER COVER STARTED TO CRUMBLE. THE NEXT MONTH, THE ENTIRE COVER CRUMBLED WITH NO EXTERNAL FORCE APPLIED. THE CHECK ENGINE LIGHT CAME ON AGAIN AND I SCANNED FOR CODES WHICH INDICATED CODE NUMBER 0456 LEAK IN THE FUEL SYSTEM. I HAVE TWICE BEFORE HAD THE SAME PROBLEM AND EACH TIME HAD TO CLEAN A LARGE AMOUNT OF RUST FROM THE FUEL FILLER NECK TO CORRECT THE PROBLEM. I HAD PREVIOUSLY TAKEN THE CAR TO THE DEALER AND ADVISED THEM OF THE PROBLEM. THEY ADVISED IF THE CHECK ENGINE LIGHT CAME ON AGAIN TO BRING IT IN FOR SERVICE. WHEN THE LIGHT CAME ON THIS TIME THE DEALER SCANNED THE SAME CODE AND DIAGNOSED THE FUEL FILLER NECK AND GAS CAP MUST BE REPLACED AT A COST OF OVER $300. I CONTACTED TOYOTA CORPORATION BUT THEY INDICATED THE CAR WAS NOT COVERED. THE CAR CAN NOT PASS INSPECTION BECAUSE OF THE POOR QUALITY MATERIALS USED IN THE FUEL FILLER NECK.
