Summary of Complaint

TL* THE CONTACT'S GIRLFRIEND OWNED A 2007 TOYOTA PRIUS. THE CONTACT STATED THAT WHILE HIS GIRLFRIEND WAS DRIVING AT 55 MPH, A GRAYISH SMOKE BEGAN TO EMIT FROM THE ENGINE WITHOUT WARNING. HIS GIRLFRIEND THEN IMMEDIATELY PULLED OVER AND EXITED THE VEHICLE WITH HER SON AS THE SMOKE QUICKLY TURNED INTO FLAMES. THE FIRE SPREAD RAPIDLY AND THE VEHICLE EXPLODED. AS A RESULT, THE AUTHORITIES ARRIVED AT THE SCENE AND THE FIRE WAS EXTINGUISHED. A FIRE REPORT WAS FILED; NO INJURIES WERE REPORTED. DUE TO THE FAILURE, THE VEHICLE WAS TOWED TO AN INDEPENDENT MECHANIC WHERE IT REMAINED IN THEIR POSSESSION. THE DEALER NOR MANUFACTURER HAD YET TO BE NOTIFIED OF THE FAILURE. THE VEHICLE WAS DESTROYED DUE TO THE FIRE. THE FAILURE MILEAGE WAS APPROXIMATELY 140,000. *LN *JB

MY WIFE AND I PICKED UP OUR 3 LITTLE BOYS FROM SCHOOL ON OUR WAY HOME AS WE GOT ON THE HIGHWAY WE HEARD THIS LOUD LONG BEEP SOUND AND IMMEDIATELY AFTER THAT MY BRAKES WILL NOT WORK SO I BEGAN PUSH DOWN ON THE BRAKE PEDAL MANY TIMES AND FINALLY BY THE GRACE OF GOD I WAS ABLE TO STOP. WE HAD THE CAR TOWED TO HAVE IT LOOKED AT AND THE MECHANIC CONCLUDED IT IS AN ABS/ACTUATOR PROBLEM WHICH TOYOTA IS VERY MUCH AWARE OF. THE MECHANIC ADVISED ME TO CONTACT TOYOTA TO FIX IT FREE BECAUSE IT IS COSTLY. I CONTACTED TOYOTA ABOUT THE SITUATION AND THEY JUST DIDN'T CARE. NOW I HAVE NO CAR BECAUSE ITS UNSAFE TO DRIVE AND I DON'T HAVE THE MONEY TO FIX IT. THIS WAS A LIFE THREATENING SITUATION FOR ME AND MY FAMILY HAD IT NOT BEEN GOD WE WOULD HAVE LOST OUR PRECIOUS LIVES.

Summary of Complaint

MY CAR HAS 115K MILES AND THE ABS ALARM WENT OFF AND THE DEALER SAID THE BRAKE SYSTEM MODULE FAILED AND NEED A NEW ONE AND QUOTE ME $3000. I CAN'T AFFORD THIS SO MY MECHANIC INSTALLED A USED PART AND STILL THE ABS ALARM ON! THIS PART HAS A RECALL THAT EXPIRED IN JAN 2018. CAN TOYOTA DO THIS FOR ME? THE CAR CAN STILL BE DRIVEN FOR A LONG TIME. THIS PART IS SUPPOSED TO LIVE MUCH MORE THAN 115K MILES AND PROBABLY MORE THAN 300K MILES.

Summary of Complaint

FRONT WHEELS LOOSE ALL TRACTION ON ICY PATCH! TRAVELING NORTH ON AN OLD PAVED COUNTRY ROAD WITH A MODERATE CROWN AND NARROW LANES, I CAME UPON A MODEST BLUFF THAT WAS JUST ABRUPT ENOUGH TO KEEP ME FROM SEEING THE ROAD SURFACE ON THE OTHER SIDE. WITHIN 50' OF THE OTHER SIDE WAS BLOWING SNOW, SOME STICKING AND TURNING INTO ICE. AIR TEMP. 27 DEGREES. DON'T KNOW THE SURFACE TEMP, AND IT WAS SUNNY, NICE. THIS PATCH WAS 500' OR SO AND PROMPTED ME TO REMOVE MY FOOT FROM ACCELERATOR. I WAS APPROACHING 50 MPH, NOT FAST FOR THIS ROAD AND WAS IN NO HURRY. WITHIN THE TIME OF A BREATH, MY FRONT END BLEW SMOOTHLY TOWARD THE DITCH AND ME AND THE PRIUS CAME TO REST WITHIN 30' OR SO. NOW THIS LIGHT TO MODERATE CROSS WIND TOOK CONTROL OF THE FRONT OF THE CAR, 'NOT THE BACK'. THE POINT BEING, REAR WHEELS ARE FREE SPINNING, WHILE FRONT WHEELS HAVE A RATHER AGGRESSIVE BREAKING EFFECT. MIND YOU, NEVER CONSIDERED TOUCHING THE 'BREAKS'. IN ADDITION, I'VE LEARNED THAT DRIVING ON SNOW COVERED TOWN STREETS, THAT IT IS BEST TO POP THE CAR INTO NEUTRAL WHEN APPROACHING AN INTERSECTION AND APPLYING THE SERVICE BRAKES, THIS ACTION WOULD PREVENT THE CAR SLIPPING OR SLIDING AT ALL. (3 MO. OLD MICHELIN DEFENDER TIRES) NOT DEDICATED SNOW TIRES, BUT IN MY EXPERIENCE, VERY GOOD. THIS TOWN I LIVE IN HAS VERY STEEP GRADES, I'M ABLE TO NEGOTIATE ALL OF IT COMING AND GOING. I BELIEVE THIS INCIDENT (STATE FARM CLAIM #[XXX]) WAS CAUSED BY THE OVERLY AGGRESSIVE REGENERATIVE BREAKING ACTION WHEN REMOVING ONES FOOT FROM THE ACCELERATOR. ADDITIONALLY, I WOULD LIKE POINT OUT THAT A HOUR EARLIER WHILE DRIVING TO MY DESTINATION, I'D DRIVEN OVER MANY DRIFTING PATCHES AT VARYING SPEEDS FROM 50 TO 70 MPH WITH A STIFFER CROSS WIND. HOWEVER I COULD SEE THEM FAR IN ADVANCE. AFTER A LENGTHY GO-A-ROUND WITH TOYOTA OVER THE PHONE, THE RESPONSE WAS, THEY WILL TAKE NO ACTION ON THIS CAR OR IN THE FUTURE MODELS. INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6). *TT

TL* THE CONTACT OWNS A 2007 TOYOTA PRIUS. WHILE DRIVING 35 MPH, THE DRIVER'S SIDE HEADLIGHT FLICKERED. THERE WERE NO WARNING INDICATORS ILLUMINATED. THE CONTACT ALSO MENTIONED THAT THE HEADLIGHTS HAD TO BE MANUALLY TURNED OFF AND ON TO FUNCTION NORMALLY. THE VEHICLE WAS TAKEN TO AN INDEPENDENT MECHANIC WHERE THE CONTACT WAS INFORMED THAT THE HEADLIGHTS NEEDED TO BE REPLACED. THE VEHICLE WAS REPAIRED, BUT THE FAILURE PERSISTED. THE MANUFACTURER AND DEALER WERE NOT MADE AWARE OF THE FAILURE. THE FAILURE MILEAGE WAS UNKNOWN.

Summary of Complaint

THE AUTOMATIC BRAKES ON THE CAR CEASED WORKING. IF I TURNED THE CAR OFF AND BACK ON, THE BRAKES WOULD WORK AGAIN FOR A LITTLE WHILE BEFORE HAVING TO STOP AND START AGAIN. I WAS ABLE TO GO ABOUT A 1/2 MILE EACH TIME BEFORE STOPPING TO TURN OFF AND ON. THE CAR WAS TRAVELING DOWN A TWO-LANE HIGHWAY WITHOUT A SHOULDER AND THEN ON CITY STREETS. WHEN I TOOK THE CAR TO THE DEALERSHIP, I WAS INFORMED THAT A BRAKE ACTUATOR REPLACEMENT WAS NEEDED. HOWEVER, BECAUSE THE WARRANT EXPIRED ON DECEMBER 31, 2017, AND I DIDN'T EXPERIENCE THE PROBLEM UNTIL NOW, THE ISSUE WOULD NOT BE COVERED UNDER ANY RECALL WARRANTY. I'VE NOW GOT A USELESS CAR, WHICH WOULD COST OVER $2000 TO REPAIR. BECAUSE THE BRAKES STILL WORK SOMETIMES, THE ACTUATOR HAS NOT FULLY GONE OUT YET, BUT THE CAR IS BASICALLY UN-DRIVEABLE. I NEVER RECEIVED ANY RECALL NOTICES ABOUT THIS ISSUE. MOREOVER, BECAUSE I WAS NOT HAVING THE PROBLEM UNTIL NOW, IT'S UNLIKELY THAT THE EXTENDED WARRANTY WOULD'VE COVERED ME IN THE FIRST PLACE.

Summary of Complaint

STARTING MAY 2015 WHOLE DASHBOARD IN MY CAR SPORADICALLY GOES BLACK, I CAN'T SEE HOW FAST I WAS GOING OR HOW MUCH GAS I HAVE LEFT OR USE MY BACKUP CAMERA IN MY CAR. FOR ABOUT AN HOUR I COULDN'T EVEN GET MY CAR TO TURN OFF. THIS HAS BEEN HAPPENING EVER SO OFTEN SINCE MAY OF 2015 AND IS VERY DANGEROUS DRIVING MY CAR IN THAT CONDITION. THE OTHER DAY MY CAR RAN OUT OF GAS ON THE BRIDGE FROM THE 5 FREEWAY TO THE 91 FREEWAY AND I WAS STRANDED ON THE SIDE OF THE BRIDGE WITH CARS PASSING AT HIGH VELOCITY BECAUSE I WASNT ABLE O SEE MY GAS METER. TOYOTA HAS KNOWN ABOUT THIS DEFECT AS SHOWN BELOW AND ISSUED A WARRANTY EXTENSION FOR ALL MODELS 2004-2009 AND MY CAR FALLS 2 MONTHS OUTSIDE OF THE WARRANTY PROGRAM AND THEY REFUSE TO TAKE RESPONSIBILITY. Summary of Complaint

TAKATA ISSUE: I AM FILING THIS COMPLAINT ON BEHALF OF CAELA ERICKSON, MY SEVENTEEN-YEAR OLD GRAND-DAUGHTER. THE VEHICLE WAS RECENTLY PURCHASED USED AS HER FIRST-VEHICLE. THE FIRST TIME SHE DROVE IT AT NIGHT, THE HEADLIGHTS DIMMED AND THEN ACTUALLY TURNED OF! THIS WAS WHILE SHE WAS DRIVING ON A DARK AND WINDING BACK ROAD HERE IN THE OJAI VALLEY ON A BUSY HOLIDAY WEEKEND. THIS IS A VERY DANGEROUS SITUATION AND ONE THAT COULD HAVE HAD TRAGIC CONSEQUENCES. WHEN WE TOOK THE VEHICLE INTO THE LOCAL DEALERSHIP, WE WERE INFORMED THAT THERE HAD BEEN A CLASS ACTION SUIT SETTLEMENT YEARS BEFORE AND THAT, ALTHOUGH THE CAR HAD BEEN SOLD USED TO THE PREVIOUS OWNER THROUGH ANOTHER DEALERSHIP, THE REPAIR WORK HAD NOT BEEN DONE. WE WERE INFORMED THAT THE WORK REQUIRED TO COMPLETELY REPLACE BOTH HEADLIGHT SYSTEMS...WORK THAT MUST BE DONE TO MAKE THE CAR SAFE TO DRIVE AND THAT WILL COST NEARLY $1000.00...IS NO LONGER COVERED. THIS IS TOTALLY UNACCEPTABLE. IF THE PROBLEM WAS BAD ENOUGH TO BE COVERED IN A CLASS-ACTION SUIT, WHY DIDN'T THE ORIGINAL DEALERSHIP INSURE THAT THE VEHICLE WAS SAFE PRIOR TO RE-SELLING IT? IT SEEMS TO ME THAT AS THE SALES END OF THE TOYOTA CORPORATION, IT WAS THEIR RESPONSIBILITY TO HAVE CORRECTED THIS DANGEROUS PROBLEM PRIOR TO PUTTING IT BACK ON THE ROAD. I BELIEVE THIS INCIDENT IS AN EXAMPLE OF WHY THIS PROBLEM NEEDS TO BE UP-GRADED TO A RECALL! THERE SHOULD NOT BE A TIME LIMIT ON SAFETY ISSUES AND CONSUMERS SHOULD NOT BE PLACED IN DANGER AND/OR HAVE TO FOOT THE BILL FOR TOYOTA'S DECISION TO PURCHASE SUB-PAR PRODUCTS FROM TAKATA.
